Terms & Conditions

  1. It is the customer’s responsibility to provide the Wynsdale Waste Management Ltd with an accurate written description of the waste to be removed off site.
  2. It is the customer’s responsibility to inform Wynsdale Waste Management Ltd of any changes to the waste description before the waste is removed off site; where appropriate notification has not been specified and the waste disposal has incurred additional charges the customer shall be invoiced additional charges as appropriate.
  3. The contract is a legally binding contract for the period of time indicated against each waste material; the contract is also a duty of care document which must be kept on file for a 2 year period.
  4. All payments shall be paid within 30 days of the invoice date unless special conditions which have been stated in the payment options have been agreed as part of the agreement between yourself and Wynsdale Waste Management Ltd.
  5. The customer is responsible for ensuring that containers do not exceed specified maximum weight requirements.
  6. The customer is responsible for any damages caused to containers and/or equipment; other than reasonable wear and tear.
  7. The customer will ensure that all equipment supplied is not improperly used, overloaded or damaged. The nominated waste carrier through Wynsdale Waste Management Limited reserves the right to charge the customer for lost, stolen, damaged or improperly used equipment pursuant to the agreement.
  8. Wynsdale Waste Management Ltd reserve the right to charge customers reasonable additional costs in line with government applied charges e.g. landfill taxes, fuel surcharges and other statutory increases.
  9. All prices listed in the contract agreement will be further subjected to VAT.
  10. The customer is required to fulfil their obligation to Wynsdale Waste Management Ltd for the full contract length specified. Any request to terminate the contract should be made in writing; it is at the discretion of Wynsdale Waste Management Ltd to decide if the contract shall be terminated.
  11. Please note that reasonable grounds are that the service is not carried out as specified in the contract. In the majority of cases Wynsdale Waste Management Ltd will require full payment for the length of the specified contract where no fault occurs on behalf of Wynsdale Waste Management Ltd. Furthermore, customers may be asked for proof that the service does not meet their requirements.
  12. Wynsdale Waste Management Ltd reserves the right to increase prices; all price increases will be communicated in writing at least 28 days in advance.
  13. The customer acknowledges that all equipment supplied by any sub contractor remains the property of those stated in the contract.
  14. Wynsdale Waste Management Ltd agrees to rebate the customer where rebate rates have been stipulated in the contract. The rebate rate is that stated at the time the contract was made. Rebated material prices may be subject to change and Wynsdale Waste Management Ltd reserve the right to change rebate prices at least 7 days in advance.
  15. Wynsdale Waste Management Ltd agree to forward information relating to the customers collection for example, where the customer requires weights to be communicated, within 28 days of the material being collected.
  16. The customer must not divulge information to third parties, which includes any information appertaining to Wynsdale Waste Management Ltd and/or all information contained within the contract. The customer shall not approach the supplier listed in the contract directly for quotation or otherwise.
  17. Any contaminated recyclable materials will be charged at current landfill rates and the customer agrees to pay for the costs incurred as a result of non-segregation/contaminated waste materials.
  18. The customer shall accept all other terms and conditions surrounding capital equipment which will be stipulated by the provider of the equipment. Wynsdale Waste Management Ltd accepts no liability for equipment/service that is provided by the contractor named in the customer agreement. In the event that the service/equipment provided is faulty or otherwise the customer must contact Wynsdale Waste Management Ltd immediately and Wynsdale Waste Management Ltd will endeavour to make alternative arrangements to fulfil the customer obligation.
  19. It is the customer’s responsibility to inform Wynsdale Waste Management Ltd of all hazardous waste removal from the customer site; waste of a hazardous nature will not be moved off site until the required hazardous producer site registration number has been received by the customer.
